Terms and Conditions of Sale

1. Seller Information

The operator of the LumenGlass online art gallery and the seller under these Terms and Conditions is:

Hereinafter referred to as the Seller.

2. Scope of These Terms

These Terms and Conditions govern purchases of artworks offered through LumenGlass, including contract formation, payment, delivery, withdrawal and the statutory rights of customers.

LumenGlass is a contemporary art gallery presenting and selling original artworks, primarily sculptures combining glass and wood, including works by Anita Darabos.

The website does not operate a traditional shopping cart. Artworks available for direct purchase may be paid for through Stripe payment links.

Nothing in these Terms limits mandatory statutory consumer rights.

3. Characteristics of the Artworks

The artworks offered by LumenGlass are original, unique creations. Generally, only one example of each artwork exists, and producing or replacing an identical piece may not be possible.

Natural characteristics of the materials, including wood grain, colour, structure and features resulting from glassworking techniques, may form part of the artwork's individual character.

Essential characteristics, dimensions, materials and known condition details are provided on the artwork page or communicated before purchase.

Photographs are intended to represent the artworks accurately, although colours may vary depending on screen settings.

Natural material characteristics do not, by themselves, exclude statutory remedies for defective or non-conforming goods.

4. Prices and Availability

Artwork prices are displayed on the relevant artwork page or specified in an individual offer. Before purchase, the Seller clearly informs the customer of the total payable price and applicable taxes.

Prices may be displayed in Hungarian forints (HUF), euros (EUR) and US dollars (USD). Customers may select their preferred currency from the available options on the website.

The selected currency is also used by the Stripe payment system, allowing customers to pay in their chosen currency. The final amount and currency displayed on the Stripe payment page are authoritative for the transaction.

The Seller operates in Hungary under the small-business VAT exemption regime (alanyi adómentesség, AAM). For transactions covered by this exemption, no VAT is charged. Where different tax rules apply, the total price including any applicable taxes will be disclosed before purchase.

The displayed artwork price includes the full cost of appropriate protective packaging and delivery arranged by the Seller. No separate packaging or delivery fee is charged.

Prices displayed in different currencies may vary due to the exchange rate applied. The customer's bank or payment provider may charge its own currency conversion fees.

As each artwork is unique, availability may change. The Seller makes reasonable efforts to keep availability information accurate.

5. Enquiries and Contract Formation

Visitors may enquire about artworks using the contact details provided on the website. An enquiry alone does not create an obligation to purchase or an automatic reservation.

For artworks available for direct purchase, the customer is redirected to the Stripe payment page, where payment can be completed in the selected currency.

Before undertaking an obligation to pay, the customer must have an opportunity to review the artwork's essential characteristics, the total payable price, delivery terms and these Terms and Conditions.

The sales contract is concluded upon successful payment and electronic confirmation of the purchase by the Seller. An automated transaction notification from Stripe does not, by itself, replace the Seller's contractual confirmation.

The Seller confirms the essential contract details and applicable terms on a durable medium, such as email.

If an artwork is no longer available due to a technical error or simultaneous sale, the Seller will notify the customer without undue delay and refund the full amount paid.

6. Payment

Online payments are processed through Stripe. Available payment methods are displayed on the Stripe payment page.

Customers may pay in the currency selected on the website: HUF, EUR or USD.

Payment card information is processed within Stripe's systems. The Seller does not store full payment card numbers or card security codes.

Successful payment is verified based on confirmation from Stripe.

7. Delivery and Collection

The Seller arranges delivery of artworks using packaging appropriate to their size, materials and fragility.

Delivery is available to all member states of the European Union, the United States of America and Canada.

Artworks are shipped using a courier service selected by the Seller or, where necessary, a specialist fine art transport service, depending on the artwork's dimensions, weight, fragility and destination country.

The displayed purchase price includes the full cost of protective packaging and delivery. No additional packaging or shipping fee is charged.

The estimated delivery time is communicated to the customer before the contract is concluded. Unless otherwise agreed, the Seller delivers the artwork without undue delay and no later than 30 days after conclusion of the contract, subject to applicable mandatory law.

For deliveries outside the European Union, customs duties, import taxes or other government charges may apply in the destination country. These charges are not included in the artwork price and are payable by the customer unless otherwise expressly agreed before purchase. Customers are informed before purchase that such charges may arise and, where their amount cannot reasonably be calculated in advance, of the basis on which they may be assessed.

Personal collection may also be arranged at an agreed location and time.

For consumer purchases, the risk of loss or damage generally passes to the customer when the customer, or a designated third party other than the carrier, takes physical possession of the artwork, subject to statutory exceptions.

If an artwork is damaged during delivery, customers are encouraged to photograph the packaging and damage and notify the Seller promptly at [email protected]. Failure to do so does not automatically remove statutory consumer rights.

8. Consumer Right of Withdrawal

Consumers who purchase artworks under distance contracts generally have the right to withdraw from the sales contract without giving any reason within 14 days after receiving the artwork.

The right of withdrawal may also be exercised before delivery.

Consumers may exercise this right through the two-step electronic withdrawal function available on the LumenGlass website.

Use of the online form is optional. Consumers may also communicate their decision to withdraw by email, post or any other unequivocal statement.

When the electronic withdrawal function is used, the Seller sends an acknowledgement of receipt without undue delay on a durable medium, such as email.

The withdrawal deadline is met if the consumer sends the withdrawal statement before the end of the 14-day period.

Following withdrawal, the consumer must return or hand over the artwork within 14 days after communicating the decision to withdraw, unless the Seller has agreed to collect it.

The consumer bears the direct cost of returning the artwork unless the Seller agrees otherwise or mandatory law provides otherwise. For artworks that cannot normally be returned by post, the estimated direct return cost must be communicated before purchase.

The Seller will reimburse payments received from the consumer without undue delay and no later than 14 days after being informed of the withdrawal, including any delivery costs refundable under applicable law. As LumenGlass includes delivery in the artwork price, the full purchase price will be reimbursed, subject to any legally recoverable diminished value.

Reimbursement will be made using the original payment method unless the consumer expressly agrees otherwise. No additional fee will be charged for reimbursement.

The Seller may withhold reimbursement until the artwork has been received back or the consumer provides evidence of having returned it, whichever occurs first.

The consumer may be responsible, subject to applicable law, for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the artwork.

The fact that an artwork is one of a kind does not, by itself, remove the right of withdrawal. Statutory exceptions may apply to goods made to the consumer's specifications or clearly personalised.

9. Statutory Rights and Non-Conforming Goods

The Seller is responsible for supplying artworks in conformity with the contract and applicable law.

If an artwork is defective or does not conform to the contract, consumers may exercise the statutory remedies available under applicable law.

Depending on the legal conditions, remedies may include repair, replacement, price reduction or termination of the contract.

Replacement may be impossible for a unique artwork, but this does not eliminate other statutory remedies.

Applicable statutory limitation periods and rules on the burden of proof apply.

Any additional statutory product liability or mandatory guarantee provisions apply where relevant.

10. Care and Handling

LumenGlass artworks may contain fragile glass, natural wood and other sensitive materials.

Customers are advised to display artworks on stable surfaces and protect them from impact, extreme temperature changes and unsuitable mechanical loads.

Artwork-specific care, cleaning or installation instructions will be provided separately where necessary.

These recommendations do not limit statutory rights relating to defective or non-conforming goods.

11. Intellectual Property

Purchasing the physical artwork does not automatically transfer copyright, reproduction rights or other intellectual property rights in the artwork.

Artworks, photographs, descriptions and other website content may be protected by copyright.

Commercial reproduction or other use requiring permission is subject to the prior authorisation of the relevant rights holder unless permitted by law.

12. Complaints and Dispute Resolution

Customers may submit complaints using the following contact details:

The Seller handles consumer complaints in accordance with applicable Hungarian law. Written consumer complaints are generally answered substantively within 30 days.

Consumers may seek assistance from a competent Hungarian conciliation body.

Consumers may also contact the competent consumer protection authority or seek a judicial remedy.

Mandatory consumer protection rules applicable in the consumer's country of habitual residence may also apply.

13. Personal Data

Information about personal data processed in connection with enquiries, purchases, payments and delivery is provided in the website's Privacy Policy.

Payments are processed by Stripe. The Seller may use Resend for delivering related email notifications.

14. Final Provisions

These Terms take effect on the date stated above.

The Seller may amend these Terms for future transactions. Contracts already concluded generally remain subject to the terms applicable when the contract was formed.

Hungarian law applies, without prejudice to mandatory international and European Union consumer protection rules.

If any provision is found invalid, the remaining provisions will continue to apply.
